It is the unanimous decision of the Employment Tribunal that the Claimant’s complaints: 1.1. that he was unfairly dismissed; 1.2. that he was the victim of unlawful discrimination on the protected characteristic of sex; and 1.3. that he was the victim of unlawful discrimination on the protected characteristic of race; are not well founded and the claim is dismissed. . 2 REASONS Background and Progress of the Case to its Final Hearing 1. The Claimant was employed by the First Respondent from 5 March 2018 to 17 November 2021 when he resigned with immediate effect. 2. The Claimant’s substantive role was as a Support Worker working in Ward K at the First Respondent’s premises. In December 2020 he began additional work as a Sessional / Flexible Worker on Ward E. 3. The Claimant was the subject of allegations of inappropriate behaviour on Ward E, made first on 3 July 2021 by Complainant 2 and Complainant 4 (which allegations they later amplified), from the Second Respondent on 7 July 2021 and from Complainant 3 on 8 July 2021. 4.
