Case Summary

This is a preliminary hearing at which the Employment Judge considered the viability of the claimant's various discrimination and unfair dismissal claims. The tribunal struck out complaints of unfair dismissal, unauthorised deductions, and certain discrimination allegations for having no reasonable prospects of success, imposed deposit orders on indirect discrimination and other claims, and issued an unless order regarding disability discrimination. Claims for harassment because of race and specific allegations of direct race/religious discrimination were allowed to proceed to hearing.

Why this outcome?

No reasonable prospects

The tribunal struck out several claims for having no reasonable prospects of success based on the evidence presented at the preliminary hearing. Other claims were made subject to deposit orders because they have little reasonable prospects of success, and the disability discrimination complaint was made subject to an unless order requiring further compliance. Only the harassment because of race claim and specific allegations numbered (6), (7) and (8) were found to have sufficient merit to proceed to hearing.
