It was apparent from the claimant’s ET1 that he was an agency worker working through the respondent company with Lifescan Scotland Limited. The claimant has insufficient service to make a claim for unfair dismissal. In addition, the remedy of interim relief is limited to “automatically unfair” dismissal and the ET1 discloses no such basis: accordingly, for these reasons the claim for interim relief was refused.
