Case Summary

The claimant's unfair dismissal complaint against Williams Lea Limited was struck out. The tribunal found the claimant had been employed for less than two years and therefore lacked the statutory qualifying period required to bring such a claim under section 108 of the Employment Rights Act 1996.

Why this outcome?

No qualifying employment period

The claimant was employed for less than two years, which falls short of the two-year minimum service requirement under section 108 of the Employment Rights Act 1996 required to bring an unfair dismissal complaint. The claimant failed to provide an acceptable reason why the complaint should not be struck out despite being given the opportunity to do so.
