Case Summary

The claimant brought a complaint of direct race discrimination against Thursdays (UK) Limited (in administration). The respondent failed to attend and did not present a response. The tribunal found the race discrimination complaint succeeded and awarded the claimant £9,146.38 comprising compensation for loss of earnings and injury to feelings.

Why this outcome?

Default — respondent did not respond

The claim succeeded because the respondent failed to present a response and the tribunal, having considered the claimant's evidence at the liability hearing, found the complaint of direct race discrimination was made out.
