Case Summary

Katy Angliss was employed as an Assistant Professor at University of Warwick from May 2013 until her dismissal for conduct reasons on 4 June 2024. The tribunal dismissed her claims for unfair dismissal, sex discrimination and age discrimination. The claimant was represented in person while the university was represented by counsel.

Why this outcome?

Claim not well-founded

The tribunal found that the respondent had a genuine belief in the claimant's misconduct and dismissed the unfair dismissal claim. The sex and age discrimination claims also failed; the tribunal found the grievance was heard as part of the disciplinary process as per policy, and the late challenge to the chair did not establish discrimination on the protected grounds.

Key Issues

  • Whether dismissal for conduct was fair under Employment Rights Act 1996 s.98
  • Whether respondent held genuine belief in misconduct on reasonable grounds
  • Whether dismissal was fair sanction within reasonable range of responses
  • Whether claimant contributed to dismissal by culpable conduct
  • Whether fair procedure would have resulted in fair dismissal anyway
  • Direct sex discrimination - failure to hear grievance and permit biased chair
  • Direct age discrimination - failure to hear grievance and dismissal
