The complaint of unfair dismissal under s. 103A of the Employment Rights Act was issued out of time and is dismissed. 2. The remaining complaints proceed in accordance with the Case Management Order of even date. REASONS Introduction 1. The Respondent had produced a bundle for the hearing, pages to which have been referred to in square brackets below where relevant. 2. The relevant background to the case was that The Claimant was employed by the Respondent between 19 February 2024 and 8 August 2024 as a Mental Health Support Worker at St Anne’s Hospital in Poole. 3. In her Claim Form, she alleged that, having disclosed two of her disabilities at work (Graves’ disease/hyperthyroidism and ADHD) she was not given the support that occupational health had advised. Rather, she claimed that she was the victim of a ‘campaign to oust’ her; minor grievances which could have been resolved easily were blown up, she was victimised and bullied during supervision sessions by Mr Kelly and Mr Johnston, she was referred to as argumentative and ultimately sent home on ‘special leave’ on 8 July. She was Case No: 6004328/2025 subsequently dismissed at a probation hearing on 8 August and an appeal was subsequently rejected on 30 January 2025 [11]. 4.
