By consent, the respondent’s name is amended to the Secretary of State for Health and Social Care. 2. The claimant’s claim of direct race discrimination contrary to sections 13 and 39 of the Equality Act 2010 fails and is dismissed. 3. The claimant’s claim of victimisation contrary to sections 27 and 39 of the Equality Act 2010 fails and is dismissed. 4. By consent it is ordered that the claimant’s deposit of £50 shall be refunded to him. The respondent consents to the refund being made without any admission that the deposit order was wrongly made and notwithstanding the Tribunal’s judgment dismissing the claimant’s Equality Act 2010 claims.
