Case No: 3322392/2021 6.2 Strike out Judgment – claim - rule 37 EMPLOYMENT TRIBUNALS Claimant: Mr K Williams Respondent: Elysium Healthcare JUDGMENT The claim is struck out. REASONS 1. By a letter dated 19 June 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claimant had not complied with the Orders of the Tribunal even after the extension from EJ Tobin dated 12 May 2022. 2. The claimant has failed to make representations in writing and has failed to ask for a hearing, even after the Respondent’s further emails and chasers, and even after the tribunal’s letter of 1 September 2022 which required a response by 2 September 2022. The claim is therefore struck out. 3. The hearings fixed for 9 September 2022 and 24 April 2023 will not take place.
