Case Summary

Two claimants brought claims against The Modern Draper Ltd (in voluntary liquidation). G Wynne withdrew his claims by email on 3 November 2025. C Sellars did not provide written confirmation of withdrawal and did not attend the hearing, resulting in dismissal under rule 47 of the Employment Tribunal Rules 2024.

Why this outcome?

Voluntary withdrawal

Mr Wynne's claims were dismissed because he withdrew them by email on 3 November 2025. Mr Sellars' claims were dismissed under rule 47 because he failed to attend the hearing and had not provided written confirmation of withdrawal.

The claims brought by G Wynne are dismissed on withdrawal. 2. The claims brought by C Sellars are dismissed under rule 47 of the Employment Tribunal Rules 2024. REASONS 1. Mr Wynne emailed the tribunal on 3 November 2025 stating that both claimants were withdrawing their claims, but Mr Sellars was not copied in on the email, nor has he provided a separate written confirmation that he is withdrawing his claim. Neither claimant attended the hearing listed for today. The respondent is in voluntary liquidation and has not submitted a response to the claim. 2. In the circumstances, I determined that it was appropriate to dismiss Mr Wynne’s claims on withdrawal and to dismiss Mr Seller’s claims under rule 47 which gives the tribunal power to dismiss the claim if a party fails to attend or be represented at the hearing.
