Case Summary

The claimant's complaint of unfair dismissal was struck out. The claimant had been employed by the respondent for less than two years, and therefore lacked the qualifying period of service required by section 108 of the Employment Rights Act 1996. The claimant failed to provide an acceptable reason why the complaint should not be struck out.

Why this outcome?

No qualifying employment period

The claimant was employed for less than two years and therefore did not meet the minimum service requirement of two years under section 108 of the Employment Rights Act 1996 to bring an unfair dismissal complaint. The claimant also failed to provide an acceptable reason why the complaint should not be struck out despite being given the opportunity to do so.
