Case Nos:2500969/2024 EMPLOYMENT TRIBUNALS Claimant: John Thomas Respondent: Ethical Pay Ltd JUDGMENT 1. The claim for unlawful deduction of wages is well founded and succeeds. The Respondent is ordered to pay the Claimant the gross sum of £1,184.59 in respect of wages owed. REASONS 2. The Claimant presented an ET1 against Respondent which was accepted on 14 May 2024. A Response was due by 21 June 2024 but none was returned. The Claimant provided further information regarding the amount of pay he was entitled to under his contract, both gross and net, the amount of gross pay claimed and provided a payslip dated 30 April 2024 showing the amount owed to him . 3. Under rule 21 of the Tribunal Rules of Procedure 2013, where on the expiry of the time limit in rule 16 no response has been presented and no application for a reconsideration is outstanding, an employment Judge shall decide whether on the available material, a determination can properly be made of the claim or part of it. If there is, the judge shall issue a judgment, otherwise a hearing must be fixed before a judge alone. 4. The final payslip issued to the Claimant shows an entitlement to the goss amount of £1,184.59. 5. That amount was payable to him under his contract on 30 April 2024 but was not in fact paid. 6.
