EMPLOYMENT TRIBUNALS Claimant: National Grid Electricity Distribution (South Wales) Plc Respondent: Health And Safety Executive JUDGMENT BEFORE Employment Judge Sharp on 28 April 2026 on the papers. UPON the Respondent issuing a Prohibition Notice reference PN AD01-07022017 dated 7 February 2017 (“the Prohibition Notice”) against the Appellant, per section 22 of the Health and Safety at Work etc Act 1974 (“the Act”); AND UPON the Appellant issuing an Appeal against the Prohibition Notice (“the Ap- peal”), per section 24(2) of the Act; AND UPON the Respondent maintaining its position, which is not accepted by the Appellant, that the Prohibition Notice was correctly issued against the Appellant; AND UPON the Respondent applying for the Prohibition Notice to be cancelled by the Tribunal, without prejudice to either party’s position as to the merits of the Ap- peal, and without any admissions being made by either party; AND UPON the parties agreeing that there should be no order as to costs; IT IS ORDERED, BY CONSENT, THAT: 1. Per section 24(2) of the Act, the Prohibition Notice is cancelled; 2. The case management hearing listed for 1 May 2026 is vacated; and 3. There shall be no order as to costs.
