He has since confirmed that there was no objection to a witness giving evidence from Canada, and therefore he has implicitly agreed to a hybrid hearing. There was no error of law in the original decision. This was a matter of case management within the normal discretion of an employment judge. In any event, the appeal is now unnecessary as the Judge has confirmed that the witness can give evidence from Canada. In the second appeal, the Employment Judge rejected an application for disclosure of documents on the ground that they were not relevant. However, the documents are prima facie relevant to the claims before the employment tribunal and the decision does not explain why the Judge considered that they were not relevant.
