The complaint in case number 1400485/2025 of victimisation is well- founded and succeeds in relation to the Respondent’s refusal to provide a reference on 10 December 2024. The remaining complaints of victimisation are not well founded and are dismissed. 3. The complaints in case number 1400485/2025 of being subjected to detriment for making a protected disclosure were presented within time, are well-founded and succeed in relation to the Respondent’s refusal to provide a reference on 23 September 2024 and 10 December 2024. The remaining complaint of being subjected to detriment for making a protected disclosure is not well-founded and is dismissed. 4. The Respondent unreasonably failed to comply with the ACAS Code of Practice on Disciplinary and Grievance Procedures 2015 and it is just and equitable to increase the compensation payable to the Claimant by 15% in accordance with s 207A Trade Union & Labour Relations (Consolidation) Act 1992. 5.
