The complaint of breach of contract in relation to notice pay is well-founded. The claimant did not commit a repudiatory breach of contract justifying her summary dismissal. She was therefore entitled to notice pay of £25,000. 2. The complaint of breach of contract in relation to a Settlement Payment of £20,000, as set out in the “clause for financial protection” that applied to the claimant’s employment contract with effect from 1 July 2024, is additionally well-founded. Remedy 3. The respondent shall pay the claimant £25,000 as damages for breach of contract, in accordance with the statutory limit imposed upon this Tribunal by article 10 of the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994. 2 4. This figure has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay.
