The complaint of the Second Claimant of failure to make reasonable adjustments can therefore proceed. 4. At the relevant time the Third Claimant was a disabled person as defined by section 6 Equality Act 2010 because of arthritis, and/or diabetes. 5. At the relevant time the Third Claimant was not a disabled person as defined by section 6 Equality Act 2010 because of depression and/or low mood. 6.
