The claimant’s complaint of race discrimination in respect of an incident said to have occurred on 17 August 2024 was presented outside the primary time limit in s.123 Equality Act 2010. However, it was brought within such further period as the Employment Tribunal thinks is just and equitable. The Tribunal therefore has jurisdiction to hear the complaint, and it will proceed to a final hearing. 2. The question of whether time should be extended in respect of an earlier incident complained of by the claimant (and said to have occurred on 10 May 2024) will be determined at the final hearing.
