Case Summary

Employment Judge Anderson ruled in favor of Santander UK PLC, finding Mr B Johnson was unfairly dismissed due to his conduct and that no compensatory award is payable as it is reduced by 100% on Polkey principles. The judge also found the Respondent's investigation had procedural defects but deemed a fair dismissal would have occurred regardless.

Key Issues

  • Is the Respondent able to prove that the reason or principal reason for the dismissal was conduct?
  • Did the Respondent undertake such investigation was reasonable in all the circumstances of the case?
  • Did the Respondent form a belief that the Claimant committed these acts based on reasonable grounds?
  • Was the decision to dismiss within the range of reasonable responses?
  • Did the Respondent follow a fair procedure?
