EMPLOYMENT TRIBUNALS Claimant: E Bradley Respondent: EE Limited JUDGMENT The claim is struck out. REASONS 1. On 12 December 2025 the Tribunal sent an Order to Mrs Bradley warning her that the Tribunal was considering striking out the claim. This was because it appeared to the Tribunal, applying Rule 37 of the Employment Tribunal Procedure Rules 2024, that the claim has not been actively pursued. 2. The Order gave Mrs Bradley an opportunity to explain why the claim should not be struck out, or to request a hearing at which to do so. Mrs Bradley has not replied. 3. I am satisfied that the grounds for striking out the claim under Rule 37 apply, and that it would be in accordance with the overriding objective in Rule 3 to strike out the claim. This is because: a. Mrs Bradley did not include any details of the claims she is making in the claim form, beyond ticking boxes identifying the types of claims she is making. b. Mrs Bradley has not complied with Orders made by Employment Judge Heather at the hearing on 11 April 2025. She has not offered an explanation for not complying with that Order. c. Mrs Bradley did not attend the hearing on 29 October 2025. She did not tell the tribunal she would not be able to attend the hearing. Nor has she offered an explanation for her non attendance since the hearing. d. Mrs Bradley has not taken the opportunity to explain why her claim should not be struck out. 4. I consider there cannot be a fair hearing of the claim as the claimant has not actively pursued it and the circumstances suggest that is unlikely to change. 5. The claim is therefore struck out.
