EMPLOYMENT TRIBUNALS Claimant: D Sullivan Respondent: Bt Group JUDGMENT The claim is struck out. REASONS 1. By a letter dated 14 July 2025 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:  the claimant had not complied with the Order of the Tribunal dated 14 July 2025.  it has not been actively pursued. 2. The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. 3. I apply the principles set out in Weir Valves and Controls (UK) Ltd v Armitage [2004] ICR 371. The claimant has not contacted the respondent or the tribunal since initiating his claim. No explanation has been provided of the reasons for this. The consequences is that it is not possible to have a fair hearing at the final hearing scheduled for 21 to 24 October 2025 when there has been apparent total failure by the claimant to engage. In the absence of any representations by the claimant, no less sanction is proportionate. The claim is therefore struck out. 4. The hearing fixed for 21 - 24 October 2025 will not take place.
