The Tribunal finds that the claimant is not an employee under section 230(1) of the Employment Rights Act 1996. Accordingly, the claim for unfair dismissal is dismissed. 2. The claimant’s claims for breach of contract involving: (i)his 5% equity stake; and (ii) his continuing interest in the debt/equity raised of 0.12% and of asset sales of 0.05% are dismissed on withdrawal, with the claimant reserving his position as to whether he will bring separate claims in the County Court.
