The claimant had a disability for the purposes of her disability discrimination complaint at the relevant time. 2. The complaint of disability discrimination may proceed to a final hearing so far as it relates to acts occurring between January 2019 and February 2020. 3. The complaint of disability discrimination is otherwise out of time so far as it relates to acts occurring before January 2019 and it is not otherwise just and equitable to extend time. 4. The complaint of unfair dismissal is in time. 5. The respondent’s application for a strike out order or deposit order in relation to the claim is refused. (V) 2 of 12 REASONS Introduction 1. This claim contains two complaints: (1) unlawful disability contrary to sections 6, 13, 39(2)(c) and 39(2)(d) of the Equality Act 2010 and (2) unfair dismissal contrary to sections 94-98 of the Employment Rights Act 1996. 2. This is a preliminary hearing to determine the following matters: (1) Whether the claimant has or had a disability at the relevant time and, if so, when? (2) Whether her disability complaint, or any part of it, has been presented in time and, if not, whether it would be just and equitable to extend time?
